OxyElite Pro Attorneys

The lawyers of Hardison & Cochran are available to review cases of hepatitis and acute liver failure in North Carolina that may be linked to the recently recalled OxyElite Pro and VERSA-1 dietary supplements.

The U.S. Food and Drug Administration (FDA) issued a notice on November 18, 2013, informing the public that USPLabs LLC, the Texas-based marketer of OxyElite Pro, had agreed to recall and destroy the product.

Prior to the recall, the FDA notified USP Labs that the dietary supplement had been linked to dozens of cases of hepatitis and acute liver failure, including one death and cases requiring liver transplants.

What is OxyElite Pro?

OxyElite Pro is a dietary supplement. According to the FDA, the product was advertised to consumers as an aid to losing weight and building muscles. Before the recall, consumers could buy it online and at supplement stores.

USPLabs LLC of Dallas, Texas, markets OxyElite Pro as well as VERSA-1.

According to the FDA, the agency learned on September 13, 2013, that a number of Hawaii residents had suffered acute liver failure or non-viral hepatitis. A joint investigation by state and federal health officials revealed that all the patients had used OxyElite Pro products.

The FDA also identified consumers outside of Hawaii who had suffered similar liver problems after taking OxyElite Pro.

According to CBS News, several of these patients required hospitalization. Two required liver transplants. One died.

Why Was OxyElite Pro Recalled?

On October 11, 2013, the FDA warned USPLabs that certain OxyElite Pro and VERSA-1 products were considered to be “adulterated.” This is because the products contained a new dietary ingredient, aegeline. The company had not provided safety evidence for this ingredient.

On that date, the FDA outlined its findings of liver problems linked to the dietary supplement. The FDA warned USPLabs to immediately stop distributing OxyElite Pro and VERSA-1.

According to the FDA, earlier in 2013, another formulation of OxyElite Pro had been destroyed after being held by the FDA through an administrative detention order.

That stockpile contained a stimulant called DMAA, which can cause high blood pressure, heart attacks, seizures and psychiatric disorders as well as death, the FDA said.

The FDA reports that USPLabs substituted aegeline, among other ingredients, after removing DMAA from its products.
